NOTICE OF A 30-DAY PUBLIC COMMENT PERIOD AND COMMUNITY MEETING
The New Mexico Environment Department’s (NMED) Surface Water Quality Bureau (SWQB) is inviting the public to comment on the draft “Total Maximum Daily Load” (TMDL) document for the San Juan and Animas watershed. The draft TMDL is available online at: https://www.env.nm.gov/surface-waterquality/tmdl. Draft TMDLs in this document include:

A TMDL is a planning document that establishes specific goals to meet water quality standards in
waterbodies where pollutant limits are exceeded. It includes current pollution loadings, reduction
estimates for pollutants, information on probable sources of pollution, and suggestions to restore or
protect the health of the waterbody.

The 30-day comment period on this document will open June 15, 2026, and will close July 15, 2026, at
5:00 p.m. MDT. Formal comments for inclusion in the public record must be submitted in writing via the
NMED Public Comment Portal at: https://nmed.commentinput.com/comment/search or alternately in

Following the close of the comment period, copies of the Response to Comments will be:
    1. Mailed to all persons who submitted written comments by July 15, 2026, at 5:00 p.m.; and
    2. Available electronically on the bureau’s website or by contacting Avery Simpson via email or

30-day Public Comment Period: Intent to Approve the LANL Site Treatment Plan for Fiscal Year 2025 and Proposed Revision 36.1

Public Notice: Los Alamos National Laboratory Hazardous Waste Facility Permit, EPA ID No. NM0890010515

Activity: The State of New Mexico is authorized to operate a hazardous waste management program in lieu of the federal program for most provisions of the federal Resource Conservation and Recovery Act (RCRA). The Federal Facilities Compliance Act (FCCA) is codified in RCRA §6001. Under the authority of the New Mexico Hazardous Waste Act, NMSA 1978, Sections 74-4-1 to -14 (1953, as amended through 2018), and the New Mexico Hazardous Waste Management Regulations (20.4.1 NMAC), the New Mexico Environment Department (NMED) may issue a Federal Facility Compliance Order (FFCO) to federal facilities located within New Mexico’s borders.
On October 4, 1995, NMED issued an FFCO to the United States Department of Energy (DOE) and Regents of the University of California (UC) (collectively, the Respondents). Los Alamos National Security, LLC (LANS) replaced UC as a co-operator in 2006. In 2019, Los Alamos Newport Nuclear BWXT-Los Alamos LLC, (N3B) and Triad National Security LLC (Triad) replaced LANS as the co-operators. The FFCO requires compliance with the Site Treatment Plan (STP) Compliance Plan Volume (CPV) for the treatment and disposal of mixed waste at Los Alamos National Laboratory (LANL). The Respondents must comply with the New Mexico Hazardous Waste Act, Sections 74-4-1 to -14 and Section 3012(b) of RCRA, 42 U.S.C. §6939(c), as amended by the FFCA of 1992, Public Law 102-386, 106 Stat. 1505 (1992).  In accordance with Section X, “Revisions” of the FFCO, all proposed or required revisions shall be made available to the public for review at appropriate locations. 
Revisions to the FFCO include but are not limited to changes in the covered mixed waste inventories and compliance dates reported in the STP Fiscal Year (FY) Update reports received by NMED since the FFCO was issued on October 4, 1995.
NMED may: approve, approve with modifications, or disapprove; the proposed STP Update for fiscal year 2025, Revision 36.1. On May 28, 2026, the Respondents DOE provided a Revised STP Update with changes to the covered mixed waste inventories and compliance dates and with corrected minor typographical errors.

Pending public input, NMED intends to approve the requested Revised STP Update and Revision 36.1.

La Ley Federal de Cumplimiento de Instalaciones (FCCA) está codificada en RCRA §6001. De conformidad con la autoridad de la Ley de Desechos Peligrosos de Nuevo México, NMSA 1978, Secciones 74-4-1 a -14 (1953, tal como estuviere modificada hasta 2018), y las Regulaciones de Manejo de Desechos Peligrosos de Nuevo México (20.4.1 NMAC), el Departamento de Medio Ambiente de Nuevo México (NMED, por sus siglas en inglés) puede emitir una Orden Federal de Cumplimiento de Instalaciones (FFCO) para instalaciones federales ubicadas dentro de las fronteras de Nuevo México.

Public Notice: The NMED Surface Water Quality Bureau opens the comment period for Clean Water Act 401 Certification of the U.S. Army Corps of Engineers Permit #SPA-2025-00353-ABQ for the New Mexico Interstate Stream Commission for the Priority I Habitat Restoration Project (Rio Grande)

The certification request is from the New Mexico Interstate Stream Commission (NM ISC) for the Priority I Habitat Restoration Project located along the Rio Grande River in Bernalillo County, New Mexico. The project's primary overall purpose is to restore aquatic, riparian, wetland, and floodplain habitat and improve hydrologic connectivity within the Middle Rio Grande. Specifically, the project would improve the quality of floodplain and low-velocity aquatic habitats that support the Rio Grande silvery minnow (Hybognathus amarus; RGSM) and enhance the ecological function of riparian, wetland, and floodplain environments within this reach.

The U.S. Army Corps of Engineers issues CWA Section 404 permits for the discharge of dredged or
fill material. The purpose of CWA Section 401 is to ensure the discharge will comply with state water
quality standards. NMED has authority under CWA Section 401 to certify, certify with conditions, or
deny certification of the permit. Procedures for certification of Section 404 permits are found at
20.6.2.2002 New Mexico Administrative Code.

The 30-day comment period on this certification request will open June 26, 2026, and will close July 27, 2026, at 5:00 p.m. MDT.  This public notice and associated information are posted at the NMED public notice website. La solicitud de certificación proviene de la Comisión de Corrientes Interestatales de Nuevo México para el Proyecto de Restauración de Hábitats de Prioridad I ubicado a lo largo del Río Grande en el Condado de Bernalillo, Nuevo México. El objetivo general principal del proyecto es restaurar el hábitat acuático, ribereño, de humedales y llanuras aluviales, y mejorar la conectividad hidrológica dentro del Río Grande Medio. En específico, el proyecto mejoraría la calidad de las llanuras aluviales y los hábitats acuáticos de baja velocidad que sustentan al pececillo plateado del Río Grande (Hybognathus amarus; RGSM) y mejoraría la función ecológica de los ambientes ribereños, de humedales y de llanuras aluviales dentro de este tramo.

El Cuerpo de Ingenieros del Ejército de los EE. UU. emite permisos de la Sección 404 de la CWA para la descarga de material de dragado o de relleno. El propósito de la Sección 401 de CWA es garantizar que la descarga cumpla con los estándares estatales de calidad del agua. El NMED tiene autoridad bajo la Sección 401 de la CWA para certificar, certificar con condiciones o denegar la certificación del permiso. Los procedimientos para la certificación de los permisos de la Sección 404 se encuentran en el Código Administrativo de Nuevo México 20.6.2.2002.

The NMED Surface Water Quality Bureau opens the comment period for Clean Water Act 401 Certification of the draft National Pollutant Discharge Elimination System permit for the Chevron Mining Inc. Questa Mine, permit # NM0022306.

This is a notification that EPA’s public notice and associated federal comment period have opened for the draft National Pollutant Discharge Elimination System (NPDES) permit for the Chevron Mining Inc. Questa Mine, permit # NM0022306. Additionally, NMED has opened the simultaneous comment period for the Clean Water Act Section 401 Certification of the draft NPDES permit.

When EPA Region 6 drafts a National Pollutant Discharge Elimination System (NPDES) permit for a discharge into one of New Mexico’s surface waters, NMED has an opportunity to assure that the discharge will not negatively affect the receiving waterbodies. This is documented through the 401 Certification and is required in accordance with state regulations at 20.6.2.2001 NMAC. NMED can make the draft permit more stringent if based on state law or can make comments to EPA for consideration in the final permit. NMED also has the authority to deny certification if the permitting circumstances will not guarantee that the discharge will meet water quality standards. 

The facility is located 3.5 miles east of the Village of Questa on NM 38, Taos County, New Mexico. The discharges from the facility are to the Red River, Segment 20.6.4.122 NMAC of the Rio Grande Basin, in Taos County, New Mexico.

Cuando la Región 6 de la EPA redacta un permiso del NPDES para una descarga en aguas superficiales de Nuevo México, se requiere que NMED concuerde con que la descarga no afectará negativamente a los cuerpos de agua receptores. Esto se documenta a través de la certificación 401 y se requiere de acuerdo con 20.6.2.2001 NMAC. NMED puede hacer que el borrador del permiso sea más estricto si se basa en la ley estatal o puede hacer comentarios a la EPA para su consideración en el permiso final. La instalación está ubicada a 3,5 millas al este de Villa de Questa en la carretera NM 38, en el condado de Taos en Nuevo México. Las descargas de la instalación son al Red River en el segmento 20.6.4.122 NMAC en la cuenca del Río Grande en el condado de Taos en Nuevo México.

The NMED Surface Water Quality Bureau opens the comment period for Clean Water Act 401 Certification of the draft National Pollutant Discharge Elimination System permit for the GCC Rio Grande, NPDES permit # NM0000116.

This is a notification that EPA’s public notice and associated federal comment period has opened for the draft National Pollutant Discharge Elimination System (NPDES) permit for the GCC Rio Grande, NPDES permit number NM0000116. Additionally, NMED has opened the simultaneous comment period for the Clean Water Act Section 401 Certification of the draft NPDES permit.

When EPA Region 6 drafts a National Pollutant Discharge Elimination System (NPDES) permit for a discharge into one of New Mexico’s surface waters, NMED has an opportunity to assure that the discharge will not negatively affect the receiving waterbodies. This is documented through the 401 Certification and is required in accordance with state regulations at 20.6.2.2001 NMAC. NMED can make the draft permit more stringent if based on state law or can make comments to EPA for consideration in the final permit. NMED also has the authority to deny certification if the permitting circumstances will not guarantee that the discharge will meet water quality standards. 

The facility is located at 11783 State Highway 337 South in the Village of Tijeras, Bernalillo County, New Mexico. The discharges from the facility are to Corral Canyon, then to Tijeras Arroyo, and then to the Rio Grande in Segment 20.6.4.99 NMAC of the Rio Grande River Basin in Bernalillo County, New Mexico.

Notice of Public Meeting on Independent Audit of the 2016 Compliance Order on Consent for LANL

Sundance Consultants, LLC is holding a public scoping meeting to hear input from the public about topics or concerns that should be included in the pilot audit of the 2016 Compliance Order on Consent for the Los Alamos National Laboratory.  
 
The Compliance Order on Consent is an agreement between the New Mexico Environment Department (NMED) and the U.S. Department of Energy (DOE) that guides legacy environmental cleanup work at Los Alamos National Laboratory. Sundance has been selected to conduct a third-party review of how effectively the Consent Order is working and whether DOE and NMED are meeting their responsibilities under it. LANL Hazardous Waste Facility Permit Mailing List
The New Mexico Environment Department (NMED) is required by regulation to maintain a Facility Mailing List as part of its oversight of the Los Alamos National Laboratory Hazardous (LANL) Waste Facility Permit (Permit).
